It applies for the certificate holder of the use of CCC Compulsory Product Certification Mark and CQC Certification Mark.

 

The certificate holder should abide by the “Regulations for Compulsory Product Certification Mark”.

2.1 Application for CCC Compulsory Product Certification Mark

2.1.1 Before using CCC Compulsory Product Certification Mark, the certificate holder should apply to the Certification Bodies Designated by CNCA and get the approval, specifically as follow:

a） If the applicant applies for the use of the standard-size certification marks printed only by CNCA, they need submit to a CNCA-designated agency the relevant document(such as the application form and copy of the certificate), apply to purchase the CCC Certification Mark, and keep the application document and the invoice.

b） If the certification mark is printed, pressed, molded, screen-printed, painted, etched, carved, stamped or sealed on the product(s) (hereinafter referred to as printed and molded)or on the nameplate(s) of the product(s), the applicant needs submit to a CNCA-designated agency the relevant document(such as the application for printing and molding the certification mark, copy of the certificate and the design of the CCC Certification Mark) , apply for printing and molding the certification mark, and keep the relevant approval document(such as the notice for the use of the printed and molded mark ).

2.2Use of CCC Compulsory Product Certification Mark

2.2.1 The certificate holder should affix the CCC Compulsory Product Certification Mark to the certified product by the Implementation Rules for the use of the Compulsory Product Certification Mark, specifically as follow:

a) The design of the mark approved to use, for example, whether an “S or EMC or S&E or F” on it;

b) Whether allow to use the irregular-size certification mark;

c) The way for affixing;

d) The position for affixing.

2.2.2 If it is not appropriate to apply the certification mark to the body of the product(s), the certification mark must be applied to the smallest packing of the product(s) and indicated in the attached document(s);

2.2.3 For certified products of a special nature (e.g. wires and cables) that would not be appropriate for certification marks to be applied, the special derivation of the “China Compulsory Certification (CCC for short)” must be printed and molded to the body of the product(s);

2.2.4 The certificate is not allowed to use beyond the scope, and the certification mark is not allowed to abuse;

2.2.5 The CCC Compulsory Product Certification Mark cannot be affixed to the product(s) below:

a) Unqualified product(s);

b) Modified product which has not been confirmed by certification body;

c) The product of which the certificate has expired;

d）The product listed on the suspension, withdrawal or cancellation certificate.

2.2.6 The certificate holder or factory shall set up a management system in the keeping and use of the certification mark to avoid the loss or the unexpected use and make a note of its using.

2.2.7 The certificate holder or factory should transact the annual inspection procedure of the approval notice for printing/molding the CCC Compulsory Product Certification Mark to a CNCA-designated agency.

 

The certificate holder shall abide by the regulations for the “Guide to Apply and Use the CQC Mark Certification”.

3.1Application for CQC Product Certification Mark

3.1.1 The certificate holder should apply to CQC Comprehensive Service Department and get the approval before using the CQC Product Certification Mark, specifically as follow:

a）If the applicant applies for the use of the standard-size certification marks printed only by CQC (hereinafter referred to as CQC standard-size certification mark), they need submit to CQC the relevant document(such as the copy of the certificate and the reference), apply to purchase the CQC Product Certification Mark, and keep the application document and the invoice.

b）If the certification mark is printed, pressed, molded, screen-printed, painted, etched, carved, stamped or sealed on the product(s) (hereinafter referred to as printed and molded)or on the nameplate(s) of the product(s), the applicant needs submit to CQC the relevant document(such as the application for printing and molding the certification mark, copy of the certificate and the design of the CQC Certification Mark) , apply for printing and molding the certification mark, and keep the relevant approval document(such as the notice for the use of the printed and molded mark ).

3.2 Use of CQC Product Certification Mark

3.2.1 The certificate holder should affix the CQC Product Certification Mark to the certified product by the requirements for the use of the Product Certification Mark from the Special Requirements for voluntary product certification by CQC, specifically as follow:

a) Whether allow to use the irregular-size certification mark;

b)The way for affixing;

c) The position for affixing.

3.2.2 If it is not appropriate to apply the certification mark to the body of the product(s), the certification mark must be applied to the smallest packing of the product(s) and indicated in the attached document(s);

3.2.3 For certified products of a special nature (e.g. capacitors and mini switches) that would not be appropriate for certification marks to be applied, the special derivation of the “China Quality Certification (CQC for short)” must be printed and molded to the body of the product(s);

3.2.4 The certificate is not allowed to use beyond the scope, and the certification mark is not allowed to abuse;

3.2.5 The CQC Product Certification Mark cannot be affixed to the product(s) below:

a) Unqualified product(s);

b) Modified product which has not been confirmed by certification body;

c) The product that the certificate has expired;

d）The product listed on the suspension, withdrawal or cancellation certificate

3.2.6 The certificate holder or factory shall set up a management system in the keeping and use of the certification mark to avoid the loss or the unexpected use and make a note of its using.

Appendix 1

Based on the Regulations for Compulsory Product Certification, namely, Order No.5 of the State General Administration for Quality Supervision and Inspection and Quarantine of the People’s Republic of China (AQSIQ), CNCA announces that Regulations for Compulsory Product Certification mark be implemented on May 1,2002.

Article 1
The following regulations are announced for statutory implementation based on relevant laws and regulations to strengthen and unify supervision and administration governing the compulsory product certification mark (hereinafter referred to as Certification Mark) so as to safeguard the legitimate rights and interests of the consumers.

Article 2
These regulations are applicable to the design approval, announcement, use and control of certification mark relevant to the Catalogue of Products Subject to Compulsory Product Certification (hereinafter referred to as the Catalogue).

Article 3
The Certification and Accreditation Administration of the People’s Republic of China (CNCA) is the competent authority to give approval of the design, announce for statutory implementation the certification mark and to exercise relevant supervision and administration.

Article 4
Any product covered by the Catalogue must first obtain a certificate from the
Certification Bodies Designated by CNCA (hereinafter referred to as DCBs), and must meet certification criteria during the validity period of certification before the Certification Mark is applied.

Article 5
The Catalogue products must be certified and applied the certification mark before they are marketed, imported, or used for any commercial purposes.
Chapter II The design of the Certification Mark

Article 6
The Certification Mark is referred to as “China Compulsory Certification (CCC)” .

Article 7
The Certification Mark consists of two identities: the core design, and the letter reference indicating the type of certification.
(1) The core design is shown in Figure I below.

(2) The letter reference indicating the type of certification is shown in Figure II below. The letter reference is printed in small capital letter(s) in the right of the core design to indicate the type of certification. The letter
reference reflects the type of certification, for example “S” represents “safety”. CNCA will design and announce for mandatory implementation the letter reference required.

Article 8
For certified special products, such as the nature of wire and cable, the three statutory CCC only, as special deviation, will be applied and not circled.

(2) The irregular-size certification marks vary in size, but must be in proportional line to the standard-size.

Article 10
The color of the Certification Mark
(1) The standard-size certification marks printed only by CNCA are of black design on a white background.
(2) If the certification mark is printed, pressed, molded, screen-printed, painted, etched, carved, stamped or sealed on the product(s) or the nameplate(s) of the product(s), the color of the background and that of the design can be reasonably altered so as to match the appearance of the product(s) or the nameplate(s) of the product(s).

Article 11
The manner in which the certification mark is applied to the certified products may be selected based on the nature of the product(s).
(1) The standard-size certification marks printed only by CNCA shall be affixed to the specified place on the outer body of the certified product(s).
(2) If the certification mark is printed, pressed, molded, screen-printed, painted, etched, carved, stamped or sealed on the product(s) or the nameplate(s) of the product(s), it shall be applied on an exposed location on the outer body of the product(s) or the nameplate(s) of the product(s).
(3) If it is not appropriate to apply the certification mark to the body of the product(s), the certification mark must be applied to the smallest packing of the product(s) and indicated in the attached document(s).
(4) For certified products of a special nature that would not be appropriate for certification marks to be applied, the special derivation of the “China Compulsory Certification (CCC)” must be printed, pressed, molded, screen-printed, painted, etched, carved, stamped or sealed on the product(s) or the nameplate(s) of the product(s).

Article 12
For compulsory products that have been certified, the Certification Mark may be applied to the packing of the products.

Article 13
Products produced overseas must apply the certification mark after being certified before they are imported, while products produced domestically must apply certification mark after being certified before they are allowed out of the factory.

Article 14
The printing of the standard-size certification marks will be specifically undertaken by a printing house(s) designated by CNCA.

Article 15
If the certification mark is printed, pressed, molded, screen-printed, painted, etched, carved, stamped or sealed on the product(s) or on the nameplate(s) of the product(s) as referred to in Article 11 (2) and (4), the applicant must submit the design to a CNCA-designated agency and can only produce the mark with the final approval of CNCA.

Article 16
The application for the use of the Certification Mark
(1) If the applicant applies in person for the use of certification mark, they need submit to a CNCA-designated agency the application form and copy of the certificate.
(2) If the applicant applies through another party or parties for the use of the certification mark, the party or parties entrusted need submit to a CNCA-designated agency the trust deed, application form and copy of the certificate.
(3) If the applicant applies through correspondence or any other communication means, they need submit to a CNCA-designated agency the application form and copy of the certificate.

Article 17
The applicant should pay the cost of the standard-size certification marks printed only by CNCA, or pay the administrative charge if the certification mark is printed, pressed, molded, screen-printed, painted, etched, carved, stamped or sealed on the product(s) or the nameplate(s)of the product(s).

Article 18
The standard-size certification marks printed only by CNCA will be granted by the CNCA-designated agencies.

Article 19
CNCA is the sole authority to supervise and administer the production, grant and use of the certification mark.
Local branches of the State General Administration for Quality Supervision and Inspection and Quarantine of the People’s Republic of China (AQSIQ) will be responsible for the supervision and check in the use of the certification mark within their respective administrative jurisdiction.
DCBs will be responsible for the supervision and check in the use of the certification mark relative to their respective certified products.
The entrusted overseas inspection agencies will be responsible for the supervision and check in the use of the certification mark relative to the certified products within their respective entrustment scope.

Article 20
The DCBs and CNCA-designated agencies are under obligation to inform the applicants of these regulations and guide the applicants in the use of the certification mark as required.

Article 21
The applicant shall abide by the following requirements.
(1) To set up a management system in the use of the certification mark, and to keep a true and complete file in the use of the certification mark.
(2) To ensure that products with the certification marks meet certification criteria.
(3) No certification marks are permitted for products when the certificate has expired.
(4) To ensure a correct use of the certification mark in promotional materials, such as any advertising or leaflet of the products, so that the consumers are not misguided or cheated.
(5) To accept the supervision and check in the use of the certification marks by CNCA, AQSIQ local branches and the DCBs.

Article 22
Certification, testing or inspection bodies designated by CNCA should ensure
the correct use of the Certification Mark in their business operations and advertisements, and they are not allowed to misguide or cheat consumers by using the Certification Mark.

Article 23
The printing house(s) undertaking the printing of the standard-size certification marks with the sole authorization of CNCA shall keep confidential the printing technology and counterfeit-proof technology. Without the authorization of CNCA, such printing house(s) are not permitted to provide any other organization or individual with the standard-size certification marks or the printing equipment.

Article 24
Should the certified products fail to meet certification criteria within the validity period of the certification, the DCBs shall request the applicant to take corrective action within a prescribed time period, and no certification mark is allowed for use during this time period.

Article 25
Administrative penalties will be imposed for any of the following irregular practices. If violation of Criminal Law is involved, legal action will be taken accordingly.
(1) Falsification, modification, trading or transfer of the certification marks.
(2) To seize and hold in possession the certification mark without approval.
(3) To use the certification mark under another party name. or
(4) Other illegal practices contrary to these regulations.

Article 26
Penalties will be imposed according to relevant regulations if the DCBs, the CNCA-designated agencies or their staff fail to fulfill their responsibilities or abuse their power.

Article 27
The applicant for the certification mark referred to in these regulations must be a certificate holder.

Article 28
CNCA will be responsible for the interpretation of these regulations.

Article 29
These regulations will be implemented on May 1, 2002.

 

Appendix 2

1 Scope

It applies to CQC’s approval and supervision of CQC marks, and the printing or molding of the marks. The category of marks includes Product Certification Marks, Environmental Product Certification Mark, and Agricultural and Food Product Certification Mark. Besides, the CNCA voluntary product certification mark, such as GAP certification, organic and organic products conversion certification, and China feed products certification, are all designed and announced by CNCA. But the relevant approval, use and supervision of the certification marks above, and the printing or molding the marks by the certificate holder, are managed by CQC, and these regulations are applicable to that.

2. Patterns, labels and colors of the certification mark

2.1 The basic design of the general certification mark

2.1.1 Pic1 legend of core design

A flat ellipse composes the basic design. “CQC”---the English abbreviation of “China Quality Certification Center”, which stands for CQC’s mark certification, is labeled inside the ring.

2.1.2 Label

a. Location of certification type label: As to indicate the type of the certification, the label of it is printed just under the core design. The label of certification type is composed by the acronyms of Chinese or English words that reflect the type of the certification. For example, “S” represents “safety”, and “ROHS” represents “the restriction of the use of certain hazardous substances in electrical and electronic equipment”.

b. Method of labeling compound certification: Compound certification means one product respectively gets through different kinds of certification, like compatible certification for safety and electromagnetic compatibility. Location of label is the same as the requirements in item “a”. Label acronyms of English words stand for multi-type of certification, and connect them with symbol “&”. For example, the compound certification for safety and electromagnetic compatibility is labeled as “S&E” in form.

c. The basic design in Pic1 applies to all sorts of certification for products, except for those announced to be with labels of certification type.

2.1.3 The color of the Certification Mark

a. The color of safety certification mark for of ecological textiles products is green（C80 M10 Y100 K0）. The standard-size certification marks are of black design on a white background..

b. If the certification mark is printed and molded on the product(s) or the nameplate(s) of the product(s), the color of the background and that of the design can be reasonably altered so as to match the appearance of the product(s) or the nameplate(s) of the product(s). Certification holders should always make an efficient control on marks using and keep related records according to the prescriptions.

2.2 Environmental Product Certification Mark

2.2.1 Pic2 legend of marks

Two nesting circles compose the design. “CQC”---the English abbreviation of “China Quality Certification Center”, which stands for CQC’s mark certification, is labeled in the inner circle.

2.2.2 Labels

The label is as shown in Pic2. The Chinese and English full names of environmental product certification ---“质量环保产品认证” and “ENVIRONMENTAL LABEL” in typeface, are respectively labeled symmetrically on both inner sides of the outer ring. The full name of “China Quality Certification Center” is labeled just under them.

2.2.3 The color of the Certification Mark

a. The standard-size certification marks are of green ( C80 M10 Y100 K0）；

b. If the certification mark is printed and molded on the product(s) or the nameplate(s) of the product(s), the color of the background and that of the design can be reasonably altered so as to match the appearance of the product(s) or the nameplate(s) of the product(s). Certification holders should always make an efficient control on marks using and keep related records according to the prescriptions.

2.3 Organic Product Certification Marks

2.3.1 The basic design is as Pic3:

The label is as shown in Pic3. “农食产品认证“ and “AGRI-PRODUCE & FOOD” in typeface are labeled just on the top of the outer circle. The full name of “China Quality Certification Center” is labeled just under them.

2.3.3 The color of the Certification Mark

a. The standard color of the inner circle is sap green（C100 M0 Y100 K0）, and the front leaf is in aqua（C45 M0 Y100 K0）. The typefaces and lines on the outer circle is in sap green（C100 M0 Y100 K0）.

b. If the certification mark is printed and molded on the product(s) or the nameplate(s) of the product(s), the color of the background and that of the design can be reasonably altered so as to match the appearance of the product(s) or the nameplate(s) of the product(s). Certification holders should always make an efficient control on marks using and keep related records according to the prescriptions.

2.4 Special pattern of the sign of “China Quality Certification”--- “CQC”, the English abbreviation of “China Quality Certification Center”, applies to special products with eligible certification, such as capacitance, pint-size switch, and so on.

3 Specification of the Certification Mark

The certification marks fall into two categories, standard-size and irregular-size certification marks.

3.1 The standard-size printed by the center has five categories. See the following tables for specification

3.2 The irregular-size certification marks vary in size, but must be in proportional line to the standard-size.

4 The application for the use of the Certification Mark

4.1 Certificate holders need submit to the Comprehensive Service Department of CQC the application form or the “Application for Printing or Molding the Certification Mark”, copy of the certificate and the design for the application.

4.2 Certificate holders need submit their recommendation (bidding on spot).

4.3 Certificate holders can transact application through providing written or electronic text of the documentaries above.

4.4 Certificate holders can apply to the Comprehensive Service Department of CQC for changing the nameplates of printed and molded signs.

4.5 When certificate holders apply for using certification marks, should pay the cost of the standard-size certification marks printed or molded supervision.

5. The use of the Certification Mark

5.1 Within period of validity, certification holders can use marks on the certificated products, their nameplates and over packs.

5.2 According to the characteristics of certified products, certification holders choose the way of using on the basis of following prescriptions:

A. The standard-size certification marks shall be affixed to the specified place on the outer body of the certified product(s).

B. If the certification mark is printed and molded on the product(s) or the nameplate(s) of the product(s), it shall be applied on an exposed location on the outer body of the product(s) or the nameplate(s) of the product(s)

C If it is not appropriate to apply the certification mark to the body of the product(s), the certification mark must be applied to the smallest packing of the product(s) and indicated in the attached document(s).

5.3 Certification holders should abide following regulations:

A. To set up a management system in the use of the certification mark, and to keep a true and complete file in the use of the certification mark.

B. To ensure that products with the certification marks meet certification criteria.

C. The Certification Mark is only used on the certified product.

D. To ensure a correct use of the certification mark in promotional materials, such as any advertising or leaflet of the products, so that the consumers are not misguided or cheated.

E. To accept the supervision and check in the use of the certification marks by CQC.

5.4 Certification marks should be stopped from using when the following situations happen:

A. The Certificate is suspended by CQC, and during the suspension, the Certification Mark is stopped from using.

B. The certificate is withdrawn or cancelled

C. The certified product or the factory’s assurance ability gets a big modification which hasn’t been verified.

6. Punishment

6.1 If the Certification Mark is abused, besides suspension or cancellation and asking for the corrective action, it will report to national administration department, and legal action will be taken according to relevant regulations.

6.2 Certification marks cannot be counterfeited or printed illegally.  National administration department will punish those who disobey the prescriptions according to related prescriptions.
