Article 1 Inorder to strengthen the supervision on the certification training bodies, and regulate the certification activities, these Measures are formulated in accordance with the relevant regulations of the Regulations of the People’s Republic of China on Certification and Accreditation.

Article 2 The term “certification training body” in these Measures means the bodies who engage the basic training activities to management auditor, products certification inspector, certification counselor, internal auditor and other personnel related to certification activities.

Article 3 Any person who engages in certification training activities within the territory of the People’s Republic ofChinashall comply with these measures.

Article 4 Certification Accreditation Administration of the People’s Republic of China (hereinafter referred to as CNCA) shall be responsible for the management and supervision on certification training bodies and its certification training activities.

Local Quality Technical Supervision Department and Local Entry-Exit Inspection and Quarantine Bodies (hereinafter collectively referred to as Local Certification Supervision Department) shall supervise and inspect the certification training activities in jurisdiction in accordance with respective duties.

Article5 Acertification training body may engage in certification training activities only after it is approved by CNCA according to relevant regulations by State Council.

Article 6 The certification training body may seek accreditation by accreditation body authorized by CNCA (hereinafter referred to as the accreditation body) to demonstrate that its certification training capability.

Article7 Acertification training body shall abide by the basic regulations of certification training are formulated by CNCA when engaging in certification training activities.

In case of a new certification training area in which there are no specific accreditation rules, regulations, a certification training body may develop its own specific rules of certification training, and examine the relevant training teacher.

The accreditation body shall appraise and confirm the training course that establish by certification training body itself and relevant training teacher’s ability.

Article8 Acertification training body shall publish the basic requirements, charge standard of certification training, and ensure the authenticity, veracity and all sidedness of the information.

Article9 Acertification training body shall implement the management of certification training lessons and training teacher, ensure that the certification training is integrated, authentic and validity, and shall not add, reduce or omit any certification training procedures and contents in accordance with the procedures of accreditation rules, regulations on certification training body and certification training lesson.

A certification training body shall make a complete record of the process of certification training, and keep such record on file.

Article 10 The certification training body shall immediately make a conclusion on certification training body and its certification training teacher, and ensure the objectiveness, authenticity for conclusion of certification training.

When measure up to requirements, the certification training body shall immediately issue the qualified certificate of certification training; for disagreement, it shall notify the trainee and give the reasons for disagreement.

Article 11 After the certification training conclusion is signed by the training teacher, and sign by principal of certification training body or its authorized personnel.

Certification training body and its certification training teacher shall responsible for the conclusion of certification training.

Article 12 the certification training body shall implement the monitor and control and evaluation related to the validity of its certification training activities, and at least to implement once internal quality system audit and management assessment every twelve months.

Certification training body shall refer the working report to CNCA in January.

Article 13 CNCA shall organize Local Certification Supervision Department to regular inspect or casual inspect the certification training bodies in holding counsel with trainee, professional counsel, making a spot check on certification training activities and results.

Article 14 Where a Unit or individual comes under any of the following circumstances, it shall be ordered to make corrections by CNCA or Local Certification Supervision Department and punishments will be enacted according to relevant laws:   

1.Engaging in certification training activities without approval by CNCA or conducts certification training activities beyond the approval scope;

2.Forging, falsely using the approval documents, accreditation certificate and mark of certification training bodies;

3.Employing the teacher who do not register and confirm with the accreditation body;

4.Setting up the sub bodies without approval or let other units to be its sub or multi bodies in other way;

5.Developing the certification training activity to other bodies, personal transfer, certification training business subcontract;

6.There has a mendacious, bombastic content in open documents, publicity release and advertisement;

7.Engaging certification training activities has not in basic regulations of certification training, relevant accreditation rules, regulations of certification training body and training lesson;

8.Other activities of violating laws, regulations.

Article 15 Any unit or individual has right to inform the CNCA and Local Certification Supervision Department of any illegal activities in certification training. CNCA and Local Certification Supervision Department shall conduct investigation and make disposition in a timely manner, and keep the informant confidential.

Article 16 To illegal activities, punish in accordance with laws, regulations and department rules related to certification and accreditation.

Article 17 CNCA is responsible for the explanation of these Measures.

Article 18 These Measures will be implemented on July 1, 2004.
